TEILNAHMEBEDINGUNGEN ERDNASE INSTAGRAM GEWINNSPIEL (English below)

Das Gewinnspiel wird von Fourmat Film GmbH veranstaltet. Teilnahmeberechtigt ist jede natürliche Person, die das 18. Lebensjahr vollendet hat. Das Gewinnspiel beginnt am 03.05.2022; Teilnahmeschluss des Gewinnspiels ist der 06.05.2022 um 23:59 Uhr. Verspätete Teilnahmen können nicht berücksichtigt werden.
Die Teilnahme am Gewinnspiel ist nur durch die persönliche Eintragung des Teilnehmers/der Teilnehmerin zulässig. Die Teilnahme über automatisierte Verfahren (z. B. über Gewinnspielclubs oder Gewinnspielservice-Anbieter) ist
unzulässig. Wir behalten uns in diesen Fällen und bei Verstößen gegen die Teilnahmebedingungen oder Manipulationen den Ausschluss der betreffenden Teilnehmer vor. Um am Gewinnspiel teilzunehmen müssen die Teilnehmenden: 1. Den Beitrag mit “gefällt mir” markieren und kommentieren: Was würdest du mit dem Kartenspiel machen?
2. Dem Account @erdnasemovie folgen.
3. Den Beitrag in ihrer Story teilen und @erdnasemovie markieren.
Mehrere Kommentare desselben Instagram-Nutzers und/oder derselben Person werden als eine Teilnahme am Gewinnspiel gewertet. Unter den eingegangenen Kommentaren wird per Los ein Gewinner zufällig ermittelt. Hierfür werden alle „Instagram-Namen“ der Teilnehmer erfasst und zur Gewinnermittlung gespeichert. Adressdaten werden später nur von den Gewinnern erfasst und nur zum Versand des Gewinnes genutzt. Den Teilnehmern stehen gesetzliche Auskunfts-, und Widerrufsrechte zu.

Gewinnbeschreibung
Zu gewinnen gibt es Zu gewinnen gibt es ein (1) exklusives Bee Erdnase 1902 - Blue Smith Back No. 2 Kartendeck, unterschrieben von Richard Turner. Die Gewinner haben sich bis zum 20.05.2022 um 23:59 Uhr zurückzumelden und ihre Anschrift für den Versand des Gewinns mitzuteilen.
Die Gewinner werden im Anschluss an das Gewinnspiel direkt auf über Instagram-Seite benachrichtigt, indem wir ihnen eine private Nachricht schreiben. Die Gewinner werden in der Nachricht aufgefordert, ihre Adresse für den Gewinnversand per Instagram-Direktnachricht an Fourmat Film GmbH zur Verfügung zu stellen. In dem Fall, dass sich ein Gewinner nicht bis zum 20.05.2022 um 23:59 Uhr eigenständig mit Fourmat Film GmbH in Verbindung setzt, verfällt der Gewinn und der Gewinner verliert seinen Anspruch auf eine Übersendung des Gewinns. Die Bekanntgabe der Gewinner erfolgt ohne Gewähr.
Fourmat Film GmbH ist berechtigt, die persönlichen Daten an Dritte zu übermitteln, um eine Auslieferung des Gewinns zu ermöglichen. Pro Teilnehmer ist nur ein Gewinn möglich, der nicht alternativ in bar ausgezahlt werden kann.
Gewinnansprüche sind nicht auf andere Personen übertragbar. Fourmat Film GmbH wird mit Aushändigung des Gewinns von allen Verpflichtungen frei. Für Rechts- und Sachmängel haftet Fourmat Film GmbH nur bei Vorsatz oder
grober Fahrlässigkeit.

Vorzeitige Beendigung des Gewinnspiels
Fourmat Film GmbH behält sich vor, das Gewinnspiel zu jedem Zeitpunkt ohne Vorankündigung abzubrechen oder zu beenden. Von dieser Möglichkeit macht Fourmat Film GmbH insbesondere dann Gebrauch, wenn aus technischen
Gründen (z. B. Viren im Computersystem, Manipulation oder Fehler in der Hard- und/oder Software) oder ausrechtlichen Gründen eine ordnungsgemäße Durchführung des Gewinnspiels nicht gewährleistet werden kann. Sofern
eine derartige Beendigung durch das Verhalten eines Teilnehmers verursacht wurde, so kann Fourmat Film GmbH von dieser Person Ersatz für den entstandenen Schaden verlangen.

Anwendbares Recht; Salvatorische Klausel; Ausschluss des Rechtswegs; Änderungsrecht
Diese Teilnahmebedingungen und die gesamte Rechtsbeziehung zwischen den Teilnehmern und Fourmat Film GmbH unterliegen ausschließlich dem Recht der Bundesrepublik Deutschland. Sollten einzelne Bestimmungen der
Teilnahmebedingungen ungültig sein oder werden, bleibt die Gültigkeit der übrigen Bestimmungen unberührt. Lückenhafte oder unwirksame Bestimmungen sind so zu ergänzen oder zu ersetzen, dass eine andere angemessene
Regelung gefunden wird, die wirtschaftlich dem am nächsten kommt, was dem Sinn und Zweck der unwirksamen oder lückenhaften Bestimmung entspricht. Der Rechtsweg ist ausgeschlossen.

Keine Beteiligung von Instagram an dem Gewinnspiel
Das Gewinnspiel steht in keiner Verbindung zu Instagram und wird in keiner Weise von Instagram unterstützt, begleitet oder kontrolliert. Der Empfänger der bereitgestellten Informationen ist nicht Instagram, sondern Fourmat Film GmbH. Sämtliche Fragen, Kommentare oder Beschwerden sind somit nicht an Instagram zu richten, sondern an Fourmat Film GmbH. Es entstehen durch die Teilnahme keinerlei Ansprüche gegenüber Instagram.

The raffle is organised by Fourmat Film GmbH. Every natural person who has reached the age of 18 is eligible to participate. The competition begins on 03.05.2022; the closing date for entries is 06.05.2022 at 23:59. Participation in the competition is only permitted if the participant enters the competition in person. Participation via automated procedures (e.g. via lottery clubs or lottery service providers) is not permitted. In these cases and in the event of violations of the conditions of participation or manipulations, we reserve the right to exclude the participants concerned. Several comments by the same Instagram user and/or the same person will be counted as one participation in the competition. To enter the giveaway, participants must:
1. Like and comment on the post: What would you do with the deck of cards?
2. Follow the account @erdnasemovie.
3. Share the post in their story and tag @erdnasemovie.
A winner will be drawn at random from among the comments received. For this purpose, all "Instagram names" of the participants will be recorded and stored for the purpose of determining the winner. Address data will later only be collected from the winners and only used to send the prize. Participants are entitled to statutory rights of access and revocation.

Description of the prize
There is one (1) exclusive Bee Erdnase 1902 - Blue Smith Back No. 2 pack of cards signed by Richard Turner to be won. Winners have until 20/05/2022 at 11:59pm to get back to us and provide their address for the prize to be sent.Winners will be notified directly on via Instagram page following the competition by us writing them a private message. The winners will be requested in the message to provide their address for the dispatch of the prize via Instagram direct message to Fourmat Film GmbH. In the event that a winner does not independently contact Fourmat Film GmbH by 11:59pm on 20/05/2022, the prize will be forfeited and the winner will forfeit their right to have the prize sent to them. Fourmat Film GmbH is entitled to pass on personal data to third parties in order to enable delivery of the prize. Only one prize is possible per participant, which cannot be paid out in cash as an alternative.claims to prizes are not transferable to other persons. Fourmat Film GmbH shall be released from all obligations upon delivery of the prize. Fourmat Film GmbH is only liable for defects of title and quality in the event of intent or gross negligence.

Premature termination of the competition
Fourmat Film GmbH reserves the right to cancel or terminate the competition at any time without prior notice. Fourmat Film GmbH will make use of this possibility in particular if for technical reasons (e.g. viruses in the computer system, manipulation or errors in the hardware and/or software) or for legal reasons a proper implementation of the competition cannot be guaranteed. If such termination is caused by the conduct of a participant, Fourmat Film GmbH may demand compensation from this person for the damage incurred.

Applicable law; severability clause; exclusion of legal recourse; right of amendment
These conditions of participation and the entire legal relationship between the participants and Fourmat Film GmbH are subject exclusively to the law of the Federal Republic of Germany. Should individual provisions of the Conditions of Participation be or become invalid, the validity of the remaining provisions shall remain unaffected. Any incomplete or invalid provisions shall be supplemented or replaced in such a way that another appropriate provision is found which comes closest in economic terms to the meaning and purpose of the invalid or incomplete provision. No involvement of Instagram in the competitionThe competition has no connection with Instagram and is in no way supported, accompanied or controlled by Instagram. The recipient of the information provided is not Instagram, but Fourmat Film GmbH. Any questions, comments or complaints should therefore not be addressed to Instagram, but to Fourmat Film GmbH.
